Evils producible by Imprisonments
In general wrongful imprisonment can will not very frequently
nor to any considerable extent upon the whole be produced
by private unempowered agency.
In a mode more or less indirect it may hence
be produced by private agency. For example
1. Locking By the wronger the wrongee imprisons the imprisonee is by force or
stealth locked in to an apartment in such sort elevated
that he can not without danger to life or limb make his
exit at a window: to any length of time he may thus and
there be kept without food.
2. Abuse of domestic power. See Offences affecting
Condition.
3. Abuse of judicial power: by By mendacious testimony
or deceptious evidence in any other shape the imprisonee
puts a deceipt upon the Judge, who thereupon for punishment
or means of eventual execution subjects the
imprisonee to the imprisonment.
2. By mendacious information or the purposely
deceptious advice the effect of imprisonment may moreover be produced.
Example. The It is the purpose of the imprisonee
to repair by sea to a certain part, He addresses himself to the
A Master of a Ship spontaneously or on application made to
him by the imprisonee informs him that he is about to sail
to that same part. He has no such intention, his intention
is to sail to another part more or less widely distant.
Embarking on the faith of this assurance, the imprisonee
subjects himself is thence, by the deceptious practice, subjected
by the Master of the Vessel to imprisonment.
