Penal CodeCh. Wrongful confinement
§. Modes of effectuation
Wrongful confinement by a private hand by the unconferred hand is still less frequent than wrongful
imprisonment. Examples are
1. Abuse or abuses of domestic power: intimidation being
employed to this effect.
2. Abuse of judicial power by false testimony or exhibition
of deceptious testimony in any other shape.
3. Rendering for this purpose the road such or such a
road or all roads leading from the place of confinement
unpassable.
4. By mendacious deceptive information or advice causing the
confinee to regard the road or roads in question as unpassable:
to wit either absolutely, or by reason of danger of
floods or rob robbers or other malefactors unpassable without danger to life
or property.
For the purpose of seduction, or As to imprisonment, so to confinement persons
of the female have been by persons of the male sex been
subjected to confinement.
Witness the case of Lord Baltimore who in
17-- was tried for a rape or a Miss Woodcock.
Had the offence alledged been Wrongful confinement
it seems not improbable that he would have been he might not improbably have been convicted
and with on sufficient ground.
