Constitutional Code.Ch. Offences affecting person
Coercion is either restraint or constraint or restraint.
In it the import of the word are included not only the idea of the effect produced
but that of the means by which it is produced,
the means to wit either physical such whereby the like
effect might be produced upon so much
or psychologic or say mental, to wit means applying
to the mind and producing the desired compliance
by the fear of preponderant eventual evil in any shape whatever as
about to fall upon the person in question in case of non-compliance
on his part with reference to the requisition
indicated.
By The acts which by means of this sort a
man may be engaged to exercise or abstain from exercising
may be either acts at large, or acts by the exercise
of which the sp place occupied by a person at the time in
question is determined. In the former case the wanted
effect produced is designated by the terms restraint and constraint
as the case may be: restraint from doing so and so; constraint
to do so and so. In the other case it is designated
by the one or other of the present term of imprisonment, imprisonment
or banishment: imprisonment when it is by physical
means – by physical obstacles to that the effect is produced:
confinement when by psychological. Not but that where
the means employed are physical that the word confinement is
every not and then employed: but the does not hold good
where the means employed are mean to be represented as being
of the psychological kind alone, never is the word imprisonment
employed.
