To be competently understood & correspondently provided
for, Offences affectg person require to be considered, in the first
place, in a conjunct point of view. One common point or
center belongs to them all: death is the common term
to which with a greater or less degree of efficiency they
all of them tend; by how many soever different routes.
Moreover in this part of the field of pen law, more
than in any other, may be seen approaching to one another,
by shades of difference scarce perceptibly distinguished,
like acts to bought by fraught with the highest degree of maleficence
acts in-different, standing midway between maleficence
& beneficence, & acts which, though not absolutely
clear of maleficence, are, however, in a preponderant &
net degree, indisputably beneficent in their respective
effects.

Consequently on this part of the field, more than on
any other, will be to be seen – matter, obviously & incontestably
belonging to the civil branch of the law; intimately
combined with matter no less obviously & incontestably
belonging to the penal branch: witness that extensive
part to which belongs the case of annoyance to person
or mind or both by modifications given to the earth's
surface, edifices thereon erected, or occupations profit-seeking
or pleasure-affording, carried on in those
same edifices.
