Penal Code§. Offences severally

seen to belong likewise to this section of the Penal
Code witness that mass of matter which regards the
several species of calamity to which person alone or person
& property in conjunction stand exposed. For in all
these instances the munificent act of man is but
too liable to exercise itself sometimes by giving
birth to the calamity in others by contributing to
the encrease of the mischief of it in others again
by omitting to do that which would be done towards
the prevention or diminution of it.
The prime distinction for consideration is
that between mind & body not that by any maleficent act
the body can be detrimentally affected of with the knowledge
of the mind without sufferance on the part of the mind
but that cases are not wanting in which the mind is
the sufferer without sufferance in any shape on the part
of the body, for although no sufferance can arrive at
the mind without passing through some channel or
other belonging to the body yet among the sufferings
to which the mind is exposed are those in the case of
which no suffering in any shape is experienced by or
in those same channels witness the eye or the ear the
most usual inlets of all sensations whether painful
or pleasurable experienced by the mind.
Only with a view to remedies used for the sake
and purpose of applying remedies in so far as applicable
with preponderant advantage are disorders evils
by whatsoever cause produced with enquiring into: remedies
– originates prevention, suppression, satisfaction, or subsequentially
prevention.
