II. Offences Severally
Ch. 1. Offences affecting person
Enactive Expositive
Art. Of the remedies applicable to an offence affecting
person in respect of the body the nature will depend
upon the nature of the maleficent act, combined
with that of the immediately operating instrument of
maleficence, if any.
Enactive – Expositive
Art. 2. Remedies applicable in all cases are
1. the antecedentially preventive: 2. the satisfactive,
3. the punitive or say subsequentially preventive.
Remedy applicable in no oter case than where the
maleficent act is continuous or quasi-continuous
or the instrument of maleficence permanently in existence
or the maleficent act a negative act, the suppressive.
Art. 3. To an offence affecting person the
antecedentially preventive remedy remedies applicable are the
same as those applying to all offences in general
namely Security- 1. imposition of the obligation
of finding security against the all succeeding offences to the belonging
to the subsequential stages in the career of delinquency: to wit, preparation, attempt
and consummation.
Art. In the case where the maleficent act is of
the negative , the nature of the suppressive remedy
will depend upon the nature of the positive act of which
the offence is the non-performance.
