That, in every case in which evil in any
shape having been produced, falsehood has knowingly
and wilfully been employed in the production
of it, suffering in some shape or degree or other,
may with preponderant advantage be employed in
the character of a remedy, has been shown already
in B.1. Ch. Instruments etc. §. Deceptions practice
Even laying out of the case the use made of
this all-initiating instrument, suppose the vexation
produced by an act exercised for the very purpose
of producing it, no sufficient cause in any shape
being producible for the justification of it, the advantage
of all parties may still require that the wrongdoer should
be made responsible for it: were it only for the purpose
of preventing wrongs of the same kind in
future: for, as in the case of corporal vexation,
so in this case, wrongs, which individually taken
amount to next to nothing, might be accumulated
into such a heap, the burden of which would
be to such a degree intolerable as to render life
unendurable. Let it here be considered that, if
suffering producible by delinquency, may be found
in particles next to nothing in magnitude suffering
in the shape of punishment, including burden
of compensation is resolvable into particles of correspondent
and equal minuteness. Accordingly in
English practice, particles of suffering of no greater magnitude
than a shilling, have even by express law, been provided
under the name of punishment, and under the name of compensation
(damages is the technical term) it is not unfrequently awarded:
