§. 5 Wrongful transfer of reputation
§. Wrongful transfer of reputation.
Art. 1. Wrongful transfer of reputation is
where the wrongee having by some individual deliberate act or
course of conduct made proof of meritorious service
or say merit, the in this or that some determinate shape
or when, though it be without any specifically meritorious
act or quality manifested by him exemplified in his person conduct on every occasion
in a determinate shape, becomes to in the eyes of the public at large,
or though it be but to a single individual an object of
favorable regard, the wrongdoer by mendacious or
other criminal practice causes it to be believed, contrar to the truth that he
the wrongee was not the only person by whom on the occasion
in question the meritorious act or conduct was made manifest, but that it was by him and a certain other individual
or individuals in conjunction, or by him and them that the merit in question was manifested displayed
by a certain other person or persons of whom he was not one
that the merit in question was at the time in question, was
exemplified.
