Ch. Defamation
§. Preventing regulations
Art. If the article being defamatory and
materially false, it be ascertained that the transprinting
was approved of its containing such falsity, or had reason for
believing it to be false, he will not the fact of it having been previously
printed in another paper, the exampled form
responsibility in respect of it.
Art. For as much as between the transprint in
question and the original print of remains, in any number
may have had place, the transprinter on on the occasion
of the reference made by him will do well to
choose for the print referred to such original print. In
case of his referring to any other in preference, it eventually may be
become matter of enquiry why such preference was given: and
if by such improper preference any profit
in any shape shall turn out to have been made or sought to have been
made by him, or any undue burthen imposed upon
any other person, he may in this case be in respect
thereof responsible.
Of the above reason some indeed nor grounds
in no other consideration than that of the advantage of the
transprinter himself: and were these all, no need is
nor would there be for imposing on him the obligation:
since, each man person being the most appropriate judge of his
own interest of what on each occasion is most conducive
to his own interest, liberty would without obligation be
sufficient: but other reasons there are⊞⊞ to wit No. and in which the object
of regard is the interest of the community at large,
is of this or that individual in publick.
