Thus a sort of arbitrary
power conferred on
the fearless
Thus was, by custom and opinion a
sort of tyranny established: a power altogether
arbitrary, conferred on the fearless—the absolutely
or comparatively fearless—over all such persons
as were either absolutely timid or less fearless
than themselves.

useful to enquire
whether the system
was originally preponderantly
beneficial—
certain that at the
present time it is
preponderantly mischievous
More curiosity than use to draw
any comparison between the mischievousness
and the beneficialness of this system of injustice
in the early ages in which it took its use:
as also, supposing it at that time preponderantly
mischievous, whether it would have admitted
of any preponderantly beneficial remedy. What
will be seen to be certain at the present
time, is that it is preponderantly mischievous,
and that it will admit of a preponderantly
beneficial remedy: a remedy, no pure
evil as any remedy can be that requires the
hand of the Law for the application of it.
