§. Property a benefit — opposite
to a benefit is a burthen

Property in whatsoever shape possessed
is a benefit. Correspondent and opposite
in nature to a benefit is a burthen.

Burthen 1 absolute or
2 relative

A burthen may be either 1. absolute
or 2. Relative, bearing relation to a correspondent benefit.
In this case, there is a mixture of two opposite
ingredients, of which, in the case in
question whatever it may be, either may
be preponderant: In case of such preponderancy,
there will be a balance, or net result,
which, according to the amount, may tender
the compound, equivalent in value to either
a benefit or a burthen as the case may be.

In whatsoever operation, the supposed
wrongdoer may have been engaged in
relation to the benefit or the burden, such
operation will, of course, have had for its
end in view, the advancement of its
own interest: if the subject matter of the
operation is a benefit, it will be
the procuring it or or acquiring a chance of it for himself,
or for some other person connected with him,
by some tie of a unity. If it be a burden, the
end in view will have been, the casting it off in present or in future,
or the procuring an exemption from it, in favour of himself or
some person connected with him, as before.
