Penal Code
§ 5.
Art.1. Wrongful disturbance of occupation
is where, by wrongful practice on the part of
the wrongor, the advantage benefit which would otherwise
have been reaped by the wrongee from the
occupation of a subject matter in his possession
or at his command is lessened.
Art. 2. Wrongful disturbance of occupation
may be either the act either of a stranger or
of a co-possessor.
Afrt. 3. If Exercised by a stranger, any
act whatever of occupation whatever, exercised
on the subject matter in question, is an
act of disturbance of possession.
Art. 4. If by a co-occupier, entitled
so to be, the disturbance of possession will
consist in the preventing the wrongee from
reaping so large a share of the benefit obtainable
from the subject matter of possession
as he was entitled to reap and would have
reaped otherwise.
☞ Apply this to a landlord and
lodger in a house, to co-occuping
of a room in a house, & an appertenance
to a house, such as a well, a pump,
a yard, a house of office etc. etc.
