Means of repression
1. Pecuniary compensation.
Most commonly it may occur, the convict will
have no means of this sort in his hands. But this
is no reason why, let the instances be ever so few,
justice should not in those few, be thus far done.
But a case by no means rare is that of a confederacy
between the thief and a person, who
gains his livelihood, in the whole, or in part, by
the sale of goods known by him to be unlawfully
obtained. In this line of dealing, the dealer
has to do with a multitude of customers. Of
these, it is on the occasion of the detection of
someone, that the detection of this same
criminal will have taken place.
In this case, if the party wronged on this
single occasion were the only party,
whose claims wrongs had a just demand for
consideration reparation, the enquiry respecting the
means of compensation in the hands of
the dealer might stop there. Often making
compensation to the party wronged, if the party
were sufficient, the remainder might either
be let go free, or in the name of punishment
transferred to some publick fund. But
whatsoever be the number of the persons
these were go to, they have all each of them special exceptions excepted, an
equal claim. And what will often happen after satisfaction of this lost,
a surplus to any degree considerable may be left. Here then, will be
