Stealing what
§. 10.
Art 1. Stealing has place is where, by wrongful
practice, without consent of any person
entitled, or by him supposed to be entitled to
give such consent, it converts to his own
use, thereby depriving of the use of it a
lawful proprietor person entitled thereto,
with intent to avoid being on that account
amenable to law.
Stealing generally
clandestine but
punishment the same
whether the stealing

Mem. In general, stealing is clandestine,
but the effect and demand for punishment
etc. may be the same, be the fact ever
so openly performed, show the it to be the
takers intention not to be amenable on
that account to the law, for example —
running away in such part as not to be
to be found.
N.B. See to the case where the goods are not &
where they are the property of the person who steals.
