But in addition to this of objection the proposed practice involves
another evil, which by its extending its influence
over the whole body of the code, is not the less worthy of
consideration. It consists in the complexedness complication of this proposed
body of arrangement; and the magnitude of the addition
it would make to the quantity of the matter in the
code. In every portion of it; this they the efficiency of it
depends upon the probability which it possesses of
being at the moment of temptation present to the
mind intended to be influenced by it. This system
of gradations
Taking the case of any person who
stands to the temptation, this system of gradations
at the moment of temptation, what is the
probability of its being present to his mind. But if
not, then in that instance is it of no use. The legislator,
who regards himself as being by education
and habits distinguished so much above the
vulgar herd, by the facility with which he can
stock his memory with arrangements adapted to
the most important purposes. Let him take in
hand this system of gradations and by with what
degree of correctness and in what length of time
he can get it by heart. Should the facility be found
not so great as he would have been glad to find
it, let him imagine what would be the degree of probability,
in the case of a man taken at random from the
most thoughtless and profligate of the uneducated multitude.
