Ch. Defraudation

Defraudation is the acquisition of profit at the expence
of another person by means of falshood dir in any shape directed
to that end.

The utterance of falshood to that purpose is the
correspondent attempt: which may be preceded by the correspondent
proposition: including every act done in the pursuance of
the correspondent design.

It is not necessary that any person in particular
should have been pitched upon for the purpose of the fraud defraudation.
Utterance of False reports having for their object the raising or lowering
prices are all so many attempts at defraudation.

For an offender who in a persuasive sense is responsible.
the proper punishment will be the publication of the trial at his
expence: in so far as if ulterior punishment is necessary it will be in the case
of any irresponsible accomplice of his. Pecuniary punishment
will not apply to their case: the principal will pay the money for
their them. In case or damage actually produced by the false report, compensation
will have place of course in this as in all other cases.

In the case of this species of offence investigational procedure is in a particular
degree requisite and necessary: without it, offence will not be pursuable
in in truth a a fifteenth part of the number of
the instances in which it will have been committed.
