§. 1. non collation of title.

§. 1. Wrongful non-collation of title is where a
person, having the power and being under the obligation
of performing an act, which if performed,
would be an efficient cause of title to another person
in respect of a certain article of property comes so to do
after, or without receiving summons as the case may
be, so to do.
