§.I 5
In a republick, the censure of the publick
opinion tribunal should naturally bear much
more severely upon this offence than in a monarchy,
especially in a monarchy built upon
corruption as in the case of the English, in which
the augmentation of the publick expense is an object
not of repression but of augmentation. In a
Commonwealth for every successful operation of
smuggling every man feels himself the poorer, he
feels it as an act of the predation committed against
himself. In a monarchy of that which is expended
upon the people, so large a proportion goes
into the pockets of the one and the few, that
the effect of the waste upon the pocket of the many,
becomes indeterminate, and remains as it
were out of right. No matter says the individual;
it is but so much out of the Kings pocket
and when this is gone he has but too much
left.
