Obstacles and Remedies.
Obstacle
Interference with the present interests of individuals
(Legislators) now in being – Ex. g. the to Register Act.
Remedy.
Postpone the commencement of the Act to a later
period.
Obstacle – strong antipathy apprehended in the people
from constitutional compact or popular prejudice
Ex. Alteration in Scotch Laws – or in the Criminal
law here.
Remedy.
Consult the people, give them time and
opportunity to declare their sentiments. Give notice
by authority of its the Law's being in agitation – make it deposable
upon Petitions being presented contra.
Obstacle – prejudice against it as being strange
& of a novel complexion.
Remedy – make it at first but temporary.
Tell them of any abuse so palpable that it
is impossible to (defend it) find the least shadow
of an argument to defend it, they will say, true
it is (very) wrong: it were to be wished that it were
otherwise. But it is idle to expect perfection in
any human institutions, and dangerous to attempt
it. We must take things as we find them: and not, by
