Penal Code

State. Burke's protegés

Sir Thomas Rumbold, Mr Warren Hastings,
Sir Elijah Impey, Henry the first Lord Melville – no one
of all these men but had he in England committed a murder, a
rape, or an act of adultery, would have been
as surely convicted and probably undergone the sentence
of the law, as the obscurest : Lord Meville
though a peer and as such trid by the House of Lords
not excepted. For Earl Ferrers being a peer, and having
committed a Murder was tried for it by the House of Peers
and having by those his Peers been convicted, was put
to death in due course of law. A peer would not himself
willingly be murdered – he would not willingly see his Wife or Daughter
ravished or seduced – even though it were by a brother Peer.

But that any under this constitution as it
stands, any man or having really done an those deeds,
of which those men were respectively accused, should
ever in the course of law be made to punished with
punishment modes that name is in politically not
to say morally impossible.

To be accused by the House of Commons, or
even in the House of Commons – this indeed though not
in name and form, is in effect punishment in effect.
But short as was the amount this suffering to the amount of
that which in case of conviction would have been
proportioned adequate to the profit or the mischief of the alledged
offence, that they were respectively exposed to this sort
of inchoate commencement punishment this beginning of sorrow, was
owing to a concurrence of circumstances too extraordinary
and too rare, to warrant the expectation of ever seeing it repented.
