Penal Code
For two different causes accounts the there exists therefore in
the case of the ruling few, a demand for a check upon
misconduct: for such a check as for the strongest check which
it is in the power of the popular or moral sanction to afford.
1. In the first place, compared with the quantity of evil produced by the
association confederacy of the ruling few, as such, the greatest quantity producible by
a member of the subject many as such unassociated, unconfederated
multitude denomination of the subject many is as nothing:
upon the largest scale operates all misconduct on the part
of the subject many operating as such – upon the smallest
upon a comparatively microscopic scal scale, all the greatest evil
produced by a member of the subject many.
2. In the next place, for the repression of all misconduct
in every shape in which they are can be under the temptation to
committ it, the subject many act under are exposed to the strongest
and most steadily operative of all checks which human ingenuity anxiety has ever or can
ever be able to apply: viz. that of the political or legal
sanction, the form of which is composed of all that infinite
quantity of the matter of punishment and the matter of reward
which it has at all times been at its disposal: for to the repression of misconduct
on the part of the subject ruling few, as such for the repression
of misconduct in any of the shapes in which the association
of the ruling few has is concerned stands engaged in point of interest to protect
it and brace one another harmless, this most efficient
of all checks – this which the only one in the force of which
any steady sure well grounded and well grounded reliance can be placed, is
not applicable law as applicable.
