Penal Code. Ch. Relation between Codes

☞ To be prefixt to the Penal Code. But it this might also
enter into the composition of the main preface in the Constitutional
Code.

Ch. or §. Relations between the several Codes – between Code and Code

1. The Non-penal is composed of expository matter
parted off from the Penal Code – Call it therefore the
Expository Code.

2. Of the Procedure Code the object and business
is – to give execution and effect to the Penal, and therein
and thereby to the Non

3. The Constitutional will naturally be composed of
a particular portion of the mea expository matter belonging
to the Penal and Non-penal Code and thence to the
Penal Code. Certain sorts of Under the general and all comprehensive name of functionaries
it distinguishes certain classes of persons from all the
res. Of the denomination of each sort of functionary it gives a definition –
an exposition: it states the rights and powers conferred
on him – and the correspondent the obligations inferred on him in consequence

way or other belong to the penal Code: take any portion of Be the matter what

of the matter of law.

A law is an expression of the will: of the will of one
person directed to the conduct of another and calling upon him
for action in the a certain direction mentioned. But on no occasion
on the part of no person does action in any direction take place,
without motives and those adequate ones. If in the mind of
the person in question motives adequate to the purpose of
producing action in the direction in question so prescribed have place already
so far so good it is well, and the law no occasion need has the lawgiver to attempt
in the mind of the law-receiver to create and up motives. But that this will be always the
case is more than any
lawgiver can in general be
assured of.
