Penal Code. Ch. Relation between Codes
To provide for this contingency – to obviate the deficiency, he
must therefore supply the law-receiver with motives and
those motives adequate ones. To do this he must impress
his mind with the eventual probability of his receiving from
a specified source either pleasure or pain: as eventually about to be experienced by him pleasure in the
event of his complying compliance with inference to the will so
expressed, or pain in the event of his non-compliance.
But for towards the production of this effect in the aggregate, pleasure will go but a
little way: in comparison of the quantity of pain of which men
at the hands of man any individual taken by himself is susceptible, the quantity of
pleasure is extremely small is small in the extreme: and
he in any given case be it ever so large, it can not always
be certain of being as so large as the quantity of pleasure which
the man might reap, or the quantity of pain which he
might avoid by non-compliance.
But if of pleasure employed in one the case of each
person individually taken is in comparison of pain so little
assured sure of producing compliance, much less is the aggregate
quantity of pleasure considered as applied to the aggregate
quantity of action which for the purpose of legislation requires
to be produced: scanty indeed and soon exhausted is the quantity of pleasure
extractable by the legislator from the aggregate of the sources: boundless and
unexhaustible the quantity of pain.
