§. 10. Offences affecting trust

Expositive
Art. 1. By an Offence affecting trust understand any
offence the of the existence of which the supposition involves in it of
necessity the supposition of the existence of a trust.

Expositive
Art. 1. By a trust understand a power or right
established for the benefit of a person other than him in whom it
is conferred or say in whom whose hands it is reposed.

Instructional
Art. or 3. For the several genres of offences of which
title to a trust is susceptible see Ch. 2 §2) Offences separately
Ch. .

Art. or 4. Distinguishable classes or denominations of
persons by whom it may happen that an offence against trust has
been committed are the following

The person or persons by whom the trust is created – say in one word the Trustee or Trustees
or Trust-founder or Trust-founders.

2. The person or persons in whom the trust power or say the
fiduciary power is conferred. Say the trustee or trustees.

3. The person or persons for whose benefit the trust power is
conferred, say the intended benefitee or intended benefitees.

4. A person or persons at large considered as acting in such
sort that the receipt and or enjoyment of the benefit in question or any part of it is
either prevented or obstructed – say the trust-disturber.

If by the disturbance
thus effected benefit
to the disturber or to any
other person is produced,
a person who in this case
will have place – will be
brought upon the stage is an unintended benefitee. The trust-disturber is the person by whom this place will most naturally be occupied. But
two cases neither of them incapable of being are – that what in which a person other than the disturber is benefited by the act of disturbance, and that where
in which no person at
all is benefited by it.
