In those days, in every part of the field of law
trust in this or that one of the modifications which in
relation to the abovementioned topics heads it is susceptible,
came upon the carpet, and became the subject matter of legislative
arrangement. But in no existing system body of law
as yet established are they to be found placed under simultaneous
conde consideration by an all comprehensive survey.
In relation to this subject not small abundant ample will be the quantity
of matter which from by the appearance it presents will scarcely
be regarded as belonging to the penal code, but which is at the
same time of such a nature that unless on the subject of in relation
so it was – that of such portion of it as indisputably and manifestly belong to the
penal code no adequately clear conception can be entertained possessed.
In this case the first aggregate mass of objects that requires to be
taken for the subject matter of observation is – the aggregate of the
powers that are capable of being thus as it were split – the power itself
being remaining in one hand in the hand of one party, and while the benefit sufferers
a part and that commonly the largest part possible
is transferred taken from that person and made over to another party:
Understand By party understand in every instance either a
single person or any other persons in any number more than one
or if person be is the word employed then as in the case of where let the plural
number as well as the singular be understood to be comprehended.
