Penal or Civil Code. Plan of the Work
§. 1. Offences affecting trust collectively
§2 § 10. Offences affectingTrust

On this occasion, if the separation in the nature of the
case the separation could be made, the first subject matter for consideration
would be – the powers the aggregate of the powers in the case
of which it is capable of being made. But no sooner are those
begun to be spoken of than it becomes manifest, that without
introducing the mention of the several parties abovementioned –
all or some of them, nothing on in relation to this subject can be said.

Case 1. Modifications of which the description of the intended benefitee – of the
party for whose benefit for whose sake the trust is creat obligation by which the
trust is created is imposed. The materials of which this part
is composed may be – taken in the way of syntheses are 1. an
individual or assemblage of individuals 2. not mutually connected by any
political tie, 2. a class of persons among which the cementing principle, or say in which the principle of
– is of the topographical kind that is to say inhabitantcy of
the same territory, forming part and parcel of the whole territory of
the political community or state. 3. a class of persons of any magnitude
associated by some cementing principle other than the above.
4. the class or aggregate of persons composed of all those who are
regarded as members of the aggregate community in question whether by means of inhabitancy
– actual or habitual, or by means of any other bond or
of association recognized as productive of that effect.

Performed upon According to this principle, the arrangement coincides with
that which has been seen applied to Offences: to wit that by which
they are divided into 1. Private. 2. Semipublic. 3. Public

Or the ar mode of arrangement employed may be the
converse of this – to wit that which proceeds by analysis.

In this case the amplitude of intended benefitee considered in respect of the
different degrees of amplitude ascribed to the fictitious entity will
be either in the first place either the amplitude corresponding to that of the aggregate composed of all the members
of the community, or an aggregate of some lesser amplitude included
in it – to wit and in this last case either an aggregate in the
case of which the cementing principle is inhabitantcy as above, or an aggregate
of which the cementing principle is any other circumstance at large, but pervading the whole community.
