§2 § 10. Offences affectingTrust
If it be a principle other than that of co-habituating
or say community of habitation as above the species of trust may
be designated into 1. domestic: 2. miscellaneous: if domestic
into 1. genealogical – and 2. non-genealogical.
Proceeding in this mode the aggregate of the members of
the community being taken for the subject matter of division, the result of the first
division of that aggregate made of the trust will be that by which the trust will be
divided into 1. Public. 2. less than public: the second that
of trusts less than public into natural and factitious: natural one
that which is formed by inhabitancy co inhabitancy, as above, and that
which is formed by genealogical relation.
Under the head of domestic trusts may be classed (according
to another principle of division 1. the natural or say genealogical, 2. the factitious
that which has place as between master and servant: in so far as
the master is considered as trustee, and the servant the correspondent entrusted
benefitee.
☞ Note here another class of person which has place, in so far as where
not a thing, but a person is the subject placed under the time in
question, as in the case of Welfare child and servant.
To the number and of the diversifications of which factitious
trusts are susceptible no law scarcely can any limit be assigned.
A multitude of person in contemplation of a certain mass of
benefit to be in some proportion and mode to be shared among
them concurr in taking upon themselves a certain correspondent
mass of obligations. Whatsoever be their aggregate number and their respective forms and nature The trusts thus created may be
comprehended under the aggregate denomination of factitious for the purpose
of distinguishtive from those termed designated by the appellation of natural as above.

Domestic Genealogical Domestic non-genealogical – by the such are the denominations
under one or other of which under the head of trusts and offences against trusts, mention will require to be made.
