Art 1. In the case of semi-publick offences,
the degree of evil produced is altogether different
and even opposite, according as it is the
person or the property that is affected by the offence.

Where it is the person, the quantity of magnitude of the evil produced,
being the same in both cases, the greater
the number of the persons affected by it, the greater is
the evil of suffering produced: if in addition to one
individual in whose tenor breast was intended to be produced,
there are twenty others, n whose breast the
same tenor is produced, the aggregate quantity of
suffering is multiplied by twenty.

Where it is the property, the magnitude of
the sum destroyed or taken in the way of depredation
being given, and the share of each person
co proprietor in it, the same, the effect of the
number is not to augment but to diminish
the aggregate of the suffering: in a word, the
quantity of suffering produced by a loss is lessened,
ceteris paribus, the greater the number of
shares into which the loss is divided.

This is the principle in part acted upon
in English aw by the arrangements by which, in the case under
certain circumstances damage is done to an individual, the
loss is transferred upon a fund raised by contributions exacted from
the whole taxable inhabitants of the country.
