Ch. Division of offences
§. Source extent of the disorder

In the case of each such condition in virtue of
the rights and powers conferred by these arrangements
the condition possesses in the case of each of them
the character of a benefit: But, on the other hand
in virtue of the obligations which are the inseparable
accompaniments of those same rights and powers,
it operates in the case of each of them in the character
of a burthen. ut in so far as by each person a condition taken
in the aggregate, the condition whether in possession
or in expectancy is considered as a benefit, the natural
and indeed only natural not to say possible
object of his endeavours is to retain it, if in possession,
to obtain it, if in expectancy. In the case, in
which it is regarded as a burthen, to preserve
shake it off, if already incumbent on him, to escape from
it if it not as yet resting on his shoulders.

In the case – where the object of endeavours is to retain
or obtain it, a cluster of offences, which will presently
come to be brought to view and named, have for their
object the possession of it. In the case where the object endeavour
is to avoid being pressed with it, another cluster
of offences
if in prosecution of that correspondent endeavour,
offences in any share are committed, another
opposite though correspondent cluster of offences require
to be brought to view and receive their several denominations
from this description it is already obvious that the denominating
which served for the first mentioned cluster of offences must be altogether
incapable of serving for any offence belonging to the latter cluster. Here then for
the two opposite clusters of offences, we have of necessity two corresp opposite but correspondent
and mutually inflammatory denominations of offences.
