Penal Code.Ch. III. Division of Offences
§. Sources of division

Sources of distinction and division in regard to Offences
are the following

1. Seat of the disorder The quarter of vulnerable part of the body natural
or politic affected

2. Division Section Extent of the disorder from this source is into 1. Private offences
2. Semi public Offences. 3. Public Offences. See
Ch. Aggravations

Subsection in regard to Private offences: the result
of it is composed of

1. Offences against affecting person. 2. Offences affecting
reputation. 3. Offences affecting property. 6. Offences affecting
person and reputation together. 7. Offences affecting person
and property together. 8. Offences affecting condition in
life. 9. Offences affecting miscellaneous rights. 19. Offences
affecting miscellaneous obligations.

2. Second Source of division relative to title.
Offences affecting title to prope to the subject matter. 2. Offences affecting the use of the subject matter.
Offences which this applies to are: 1. Offences affecting a
property.

Third source of division: duration of the mischievous
Offence or of the mischievous result. Offences
evanescent and Offences continuous. Result of the division
1. evanescent. 2. permanent – Use of the division indicating the
nature of the remedy: of the remedy requisite and applicable

4. Fourth source of division – relation of the act to the result.
Offences inchoate and consummate. See Chapter thus intituled. Use

5. Source the firth. Logical quality in relation of the
act. Offences positive and negative. Uses making sure
that no article having a title to be admitted into the list has been omitted.

6. Source the sixth
Offences affecting trust. See Ch. Offences affecting
trust. These are 1. Offences by trustees. 2. Offences against trustees as such. 1. Offences affecting self-serving power or use. 2. Offences affecting trusts.

7. Source of the seventh. Number of the persons
concerned in the Offence. See Ch. Co-Offenders.

8. Source the eighth. – Relation of the Offences to title.
This applies only of Offences affecting property, Condition in
life, or rights and Miscellaneous obligations. 1. Offences affecting title. 2. Offences affecting
use and benefit.
