Penal Code§. Definitions & Distinctions
Out of punishment Only to a comparatively very limited extent can
satisfaction be made thus to arise. But in every case
in so far as it can be made thus to arise, so under the greatest
happiness principle it ought to be will be.
Of misdeeds the prevention of which as above can not with
a balance on the side of pleasure be brought about by the
power of government, that is to say, as above, by punishment
produced by the force of the legal sanction, the privation must
under according to the greatest happiness principle be left to the force
of the popular or moral sanction, a fictitious Legislative
authority having for for the giving execution of and effect in its commands its correspondent judicial authority in
the Public Opinion Tribunal.
Nowhere as yet have the fictitious laws enacted
by the force authority of the popular or moral sanction been throughout
the field of action been in exact conformity to the
dictates of the greatest happiness principle. But everywhere,
as experience observation and reflection
in relation to the causes and effects of human action in
respect of pleasure and pain encrease, the dictates of the
two imaginary fictitious authorities will come nearer and nearer
to exact coincidence.

given to the branch of art and science by which endeavour is
made⊞ ⊞ in regard to such act as can not without preponderant pain as above be taken for subjects of effective prohibition to show in every sort of -admitting case that can occur case that can occurr what
course of conduct is most conformable to the dictates of the
greatest happiness principle.
