Ch. III Division of Offences.
§.
Division into simple and complex.
For the sources of complexity in suits and accordingly
in offences, see Delay, Vexation and Expense
Tables in Scotch Reform.
Here follow two offences which under
these their names, present a demand for insertion
in the list of offences, being both of them
complex, though in different ways.
1. Complex in respect of the multiplicity
of co-offenders, and thence in case of prosecution
co-defendants, all offences, individually taken,
in the commission of which persons more than
one participate: say, complex in respect of the
number of co-offenders.
2. Rest The several offences by which vulnerable
parts more than one are affected at the
same time. Examples 1. Offences against affecting person and reputation: 2. Offences against person and property: 3. Offences affecting condition in life.
3. Riot – by this appellation, and as in English
practise, designate a complex offence, in the course
of which, at one and the same time, divers persons,
some separately, some conjointly, are occupied
in committing partly by force, partly by intimidation,
an offence or offences, some against
person, some against property, of the same or
other persons, and overcoming whatever resistance
is offered to the prosecution of the criminal or
culpable enterprise.
