Where person the
premeditated subject
matter the mischief
greater than where
property alone.
For, setting aside the Pretium affectionis a wrong
which when its subject matter is Property and nothing
more is in its nature susceptible of compleat and identical
compensation, which is not the case where it is
Person that is the subject matter of the wrong.
Thence it is that where Person has been the
premeditatedly intended subject matter of the
wrong, the mischief of the second order is much
greater than when Property alone has been the
subject matter of the wrong.
☞ Note here take into consideration the words
of the English law in a riot. Consider whether to
preserve and to expound it or to eliminate it.
☞ Take here into consideration the eight several
species of chronical offences as in Dumont: See
whether these are all that can be found, and enumerate
under them the several subspecies as per table
of Offences.
