From the division to which as above it an offence belongs, no
adequate judgment can be formed respecting the degree of its mischievousness in which it is mischievous;
still less of the quantum of punishment or other of suffering
for the purpose of applying remedy in any other shape which
it may be needful to attach apply to it.

1. So far as regards the mischief of the first order,
from an offence, the mischief of an Offence affecting
property so far from its being encreased by being converted into
a semi public offence and still more by its being converted
into a public offence, is encreased by its being a semi public
offence and still more by its being a public offence.

Reason. By the distribution of the which in regard to the
loss has place where the offence is a semi public offence, the quantity
of suffering produced by it is diminished: and still more when
it is a public offence. According to its extent either if not
in the state of a semi public offence it is reduced as it were
to the state of an , the sensation which
is no more than one individual a loser or no more than a few
individuals losers would be more or less severely felt being by
the distribution rendered imperceptible.
