Offences affecting person
require all to be considered
together

All these offences require to be considered
together

Reason any one or more
may be produced by accident in the pursuance
of one & the same
design

The reason is that, with very few
exceptions by one and the same act, and
in pursuance of one and the same design
they may anyone or more of them by the
intervention of accident be procured.

Reason for the distinction
compensation remedy
to be determined by the
result produced

Reason for the distinction this: determines
by the maleficent result should be the satisfactive
and in particular the compensative
remedy.

Punifactive remedy
by the result intended

Determined by the effect or say ultimate
result intended should be the punifactive or
say subsequentially preventive remedy.

Consequently be the evil actually produced
ever so great, if no evil effect were produced
no punifactive remedy as such can
be needful nor accordingly ought to be applied.

Reason evil of 2d order
none

Reason; evil of the second order, none: danger
none; and in so far as the state of the case is understood,
alarm none.

Provided there be no
temerity or evil consciousness

Provided always that no temerity any more
than any evil consciousness has had place.

Thus far the topic matter respecting offence by which
person is affected wears a penal defeat; and to
the Penal Code will belong the consideration of it.
