Excepted from the case of delinquency affecting
person is the case of legal power exerciseable in or
upon person; that is to say power domestic, military,
or judicial; as to which see b. I. Ch. VIII. Justifications.

Reasons for the establishment of such
power; these: 1. need thereof for the creation
and preservation of the good in the shape
of in which it is produced by means of the
several relations thus alluded to: 2. evil
of the second order as above, none, or none
but what is outweighed by the good: danger
preponderant, none, alarm preponderant,
none.
