Law Amendment or Penal Code

Every end has To every end there is legitimate or illegitimate corresponds
a principle which prescribes dictates the acting in conformity
to that same end. But it is only with exception not
exactly true that to every principle corresponds an end.
One exception there is, and that is that principle which as
yet has not as yet obtained any what may be recognized denomination
what may be termed the imitation principle of imitation
or say for shortness imitation principle. This is the
principle out of which like the cobweb from the bowels of
the spider the law Judge-made law in its
two great masses â the Roman and the English have been spun.
A case comes before a Judicatory for decision. From
what source shall the decision be drawn? From all the
aggregate of all such known or supposed decisions called forth by the aggregate
of all such cases to as cases
to which this the can be made or appear to
have more or less resemblance. As to whether it be
conformable to the the decision which would be dictated
by the greatest happiness principle â by a desire by
on the part of the Judge to contribute in so far as the nature
of the case allow admitted of his contributing to the gre
maximum of human happiness â this is a question to
which an all comprehensive institute of Law on that
part of the field which is in question it may have happened
once to have come upon the carpet.
By two distinguishable authorities has this same
principle been employed and brought into action â 1. the Judicial,
2. the Legislature by two species of law distinguished by
reference to their sources, 1. Judge made Law and Legislature
made.
