Penal Code Ch. Offences against Reputation
1. Addenda 1. The Punishment inflicted by the Public Opinion Tribunal upon an unoffending
individual, or for a mischievous offence, produces by its
effects of the second order as much good as if he had been partaken
in the offence: only in case of discovery of his non offendingness
are is the correspondent bad effect of the second order, to
wit alarm, produced.
2. If, to no person taken to it is agreable to become an
object of censure by the Public Opinion Tribunal, to every
person it is in a greater or less degree agreable, to act as
a member of the Public Opinion Tribunal, and as to such
to contribute to censure pronounced on others.
3. Were it Setting aside the evil effects produced by
ter exe a censure condemnatory opinion of the Public Opinion Tribunal when discovered
to have been unjust it may be to in general be doubted
whether the suffering produced on the part breast of the individual who
is the object of the censure, be not in general overweighed by the aggregate
of the enjoyment produced on the part of the persons who in
quality of members of the Public Opinion Tribunal take
cognizance of the supposed offence, and eventually censure
in a judgment of censure.
