Penal Code
Follow the points of and diversity the
points of the agreement and disagreement by which
the mutual relations of those several modifications
of falshood are may be brought to view.
The subject of the falshood may be either
a proposition at large to wit a proposition by which
the existence of the matter of fact in question, be
it what it may is ascerted, or the existence of
a certain person to wit, the existence of a certain such
or such an individual person in the character of one by
whom a proposition to any such effect as
the above has been asserted: to the former of
these descriptions belong the several cases of
simple falshood spoken by audible signs – 2. Simple falshood
scriptitious visible signs 3. Simple falshood by deportment or
miscellaneous signs 4. Forgey of real evidence
5. Perjury: to the latter 1. Deceptious personation,
2. Forgery in the ordinary acceptation of
the word.
In the former of these cases that security which is
considered as provided against falshood by the solemnity and
thence the deliberateness of the assertion, with or without
a form of words by which the force of the religious sanction
is regarded as being applied to that same purpose
may either have had place or not: the cases in which it
is not considered as having had place are the four first: the
case in which it is considered as having place is the 5th.
