Penal Code
The Instruments employed in conveying the conception the
intended erroneous conception which is the intended product
of the falshood are either appropriate, or unappropriate:
the appropriate are either 1. the visible audible signs abovementioned
or 2. the visible signs abovementioned.
Appropriate Instruments of discourse are those
which having been invented for this purpose – viz. for
the communication of conceptions from man to man
are commonly employed for this purpose and constitute
the matter of Language or discourse: the
unappropriate are those Instruments or signs
which come under the general name of Deportment
and which, though not invented for this purpose
are capable of being occasionally made subservient
to it.
In the case where the Instruments or signs
employed are of the unappropriate class, the
fact the existence of which is thereby endeavoured
to be rendered the subject of the erroneous belief
is either 1. the very fact in question or 2.
some other fact from the supposed existence of
which the existence of the very fact in question is
expected and intended to be inferred: to the first of
these cases belongs that of simple falshood conveyed
by deportment, to the latter that of forgery
applied to real evidence.
