Penal Code

In regard to the production of preponderant evil,
between the one set of instruments and the other another there is
however this difference. Physical power, intimidation and
allectation are no less well adapted and necessary to the production of
good than to the production of evil: whereas it is to the production of evil
in a much greater proportion than to the production of
good that deceptious practice is adapted. the Natural
and constant is the tendency of deceptious practice to produce
evil – preponderant evil – accidental and rarely
exemplified is its tendency to produce goods preponderant
good. Constantly necessary to the production of good in throughout the whole course of human
practice is right information applied to this conception
by which agency is about to be guided directed, rarely necessary
or conducive to the production of good to wit by exclusion aversion
of evil or wrong information or say misinformation.

Thus Such being the case, only to the giving so beneficial
direction to the object moving is the legislator occupied in the
case of the subjectment of regard to physical
force intimidation and allectation, in regard to deceptious practice
practice when with relation to presumption, who has at constant and all comprehensive exclusion the few excepted cases
above alluded to excepted.

☞ State next the cases in which deception and this
deceptious practice is productive of preponderant good. 2. how
it comes to be so! 3. the evil which it tends to produce
even in these cases: viz. lessening mans confidence in the assertions
of the discourse discusses Case of a medical practitioner. This
operation will not hurt you. This medicine will not be nauseous to
you.
