Penal Code
Deceptious practice its modifications –
falshood at large, forgery, personation, perjury or say
judicial falshood supposition of evidence.
Art. 1. Falshood at large – forgery personation
– perjury or say judicial falshood suppression of
evidence, under these heads or reducible all the modifications
of deceptious practice to the designation of
what any denomination in general have as yet
been applied. Falshood at large the instrument or product of fallacious representation is the all comprehensive
aggregate force which those others are but so many attached
portions.
Falshood has been distinguished by into logical
and ethical – anti-logical and anti-ethical they might
have said.
Falshood anti-logical is where and so far as the
is the conception intended to be conveyed concerning in relation to the state
of the things in question actually as is a copy of the things
in that same state.
Falshood anti-moral is where and so far as the
conception intended to be conveyed is in the judgment and
belief of the utterer is believed by the utterer to be an unlike
copy of those same things in such their state.
By anti-logical falshood the character of the utterer
may or may be affected or not, according to circumstances
the intellectual faculty, the judgment is in this case of the
faculty which if any is affected: it is affected in so far as
it is the result of a wrong conclusion in a case in which by
a judicial faculty of greater potency a right conclusion
would have been drawn from the same supposed matters
of fact as real or supposed.
