Penal Code
In the case of forgery as such the object misrepresented
is notthe necessarily any object constituting the subject matter of the
forged discovery: it is matter more or less than the person
whose discovery the discourse was or is represented as
being forgery may be committed by the former, if a
portion of discourse in every point true. In the case of the
utterance of a forged written instrument many principles not a for example
the Examples what the utterer virtually says is John Brown is
the person by whom the words John Brown at the
end of it were written whereas it was not any John person
whose name was John Benjamin Brown but a person whose name
was Thomas Walter White.
As to the utterer if in this case he knew that
the words John Benjamin Brown were not written by the
Benjamin Brown in question or his mind is in
that state which may be termed a state of evil consciousness:
he is curious of his being the tendency of his not
used to or occupied in the exercise of.
If instead of knowing that the words Benjamin
Brown were not written by him by whom
they purport to have been written, he believes them to have
been written by that same Benjamin Brown, in
that this case no such evil consciousness has place in on his
case part: there would be neither need nor use in applying
to him his action intendedly to his case repressive power of punishment.
