Upon the whole, of a general permission rule to the effect in question
the pernicious evil consequences would could not, on a close consideration be
found so evil as upon first mention, in fir the reasons above
mentioned they would be apt to appear to be. The reason
is that in comparison of the cases in the sekf which falshood
falshood the effects purposes following upon the falshood in
question could ever in the eyes of the utterer himself be good then
the number will always be extremely small in comparison
of those which they could not fail to be in his eyes extremely
large: proportionably small therefore in point and knowledge would be the non-
that in any this or that succeeding instance the a declaration made by an
individual their circumstances would be found .

Comes now the practical rules of that this subject
should be adopted and conformed to with a view to punishment.
It is this these. In case of falshood take the goodness of the purpose
for an efficient cause. 1. Take not the circumstance for a ground
either of justification or of exemption. 2. Take it for a ground
of extenuation: and in this character give it the effect of exempting
the individual from any portion proportion of the punishment which
might otherwise be due apt: in such sort that it may be
less by no more than a minimum quantity than the greatest proportion quantum of or less than the lowest quantum
allowable.

☞ Proceed to note the cases in which every person would be made
to allow this as an adequate cause of exemption: Example –
preventing an intended and endeavouring criminal from
his intended crime that crime being a higher mischievous as
for example wrongful homicide &c.
