Penal Code13.7. General Titles
Ch. IV. Instruments of delinquency.
Ch. Offences by falshood
Ch.
Of Offences by falsehood and Offences against trusts and
of Offences by falsehood
Art. 1. Two classes descriptions of offences there are which
extend over the whole field of delinquency. These are
Offences by falshood and Offences against trust.
First as to Offences by falshood
Falshood is an instrument capable of being
employed and habitually employed in the service of
wrong in every one of its shapes.
But cases are not wanting there are cases in which, when while produced
by this instrument the act of producing evil suffering takes the character of wrong
although if were it not that this, or some other instrument
of evil such as the physical force or threats of
inflicting it, the production of the suffering would not
have any such character as that of wrong imprinted
on it.
Of this sort are cases of competition in general,
competition between individual and individual for benefit
in whatsoever shape. Instance, competition for profit if
made – competition for beneficial offers – competition
for the affection of the correspondent and opposite sex.
