Penal Code.

produced. Take for example the case of depredation:
of a man who has committed such or
such a crime, say that he had committed it –
here is defamation; but the defamation has
nothing in it. If on the contrary, he has not
committed it, and you say that he has committed
it, here is falsehood uttered, and by
this circumstance, the defamation is rendered
wrongful. So in the case of a report
spread of news the effect of which is to produce
a rise or fall of prices. If the report is true,
no wrong is done to any person by the first utterance
or spread of it. If the report is untrue,
or if false, here, by the falsehood, wrong is done
to persons in any numbers: more especially,
if he by whom the falsehood was uttered,
was the inventor of it, or by any other
means knew it to be false, and it was
for the purpose of producing this effect, to
the intent that he might by anything cheaper
or sell anything dearer, that he thus uttered
it.
