5 §. deception &c.
instance, in which the legislator actual
or virtual, forbears to attach punishment to
the deceptitious act he grants a virtual license
to that same act and all its consequences.
Whatsoever punishment
attached to deceptious
falsehood, the oath not only
needless for repression
but worse than useless
Whatsoever the punishment, which
or other means of repression which it may be proper to attach to the mischievous
act, forcing a person to take part in that same
ceremony or any other ceremony is altogether
needless to the purpose of such repression. It
is, therefore, useless: and for as much, as there are
many cases, in which, the ceremony cannot
be employed, whereas there are none, in which
those means of repression cannot be employed,
hence the ceremony is not only useless, but
much worse than useless.
