§. 1. Results announced.
3. Of whatever portion of burthen is thrown upon
the author of the suffering, the effect will be in general
to put persons upon their guard against engaging in
any immediate acts of which it may happen to be
productive of evil ultimate results.
4. In many an instance, blame in respect of
negligence, as rash missupposal in a case in which
no evidence of the existence of it happened to have place,
or evidence which, at one time was in existence,
has perished or ceased to be obtainable.
5. All other circumstances equal, aggregate intensity
of the burthensome sensation is diminished, in proportion
as the loss, which is the efficient cause of it,
is divided. Short proofs: 1. the universally acknowledged
usefulness of Insurance offices against casual
loss; 2. The instances where indemnity for loss is
given to individuals at the vicinnage, or that of
the public at large.
In this case, the quantity of the compensation
will be determined altogether by the joint consideration
of the pecuniary prosperity, absolute and comparative,
of the two parties — the author of the suffering and the
sufferers.
IV. So, in the case of unintentionality, with respect to the
immediate act.
