Penal CodeCh. IV States of the mind &c
1. Where vitious will or understanding are wanting, punishment none.
2. Where vitious will and understanding are both present, we may of
case in which mischief is produced.
Intention not to be to law, lessens but tells not the demand for punishment
Manifestly In any every no one of the above supposed cases could punishment
be of any use. By the punishment inflicted on you To the prevention
of no evil design could the example of punishment inflicted
upon you be necessary or conducive: for no person harbouring entertaining
any evil design would behold himself in your case.
On the contrary if punishment inflicted on you in any such
case, the effect would be mischievous. Any man might say
to himself behold in the case fate of this mean a fate from against
which no it is not in the power of innocence to
save me.
