Ch. VI. Concatenated Offences inchoate and consummate
In the denomination of concatenated
offences – for the distinction between
offences consummate and offences
introductory. And in regard to offences
introductory, for the distinction between division into,
preparations and attempts, the demand is
produced by the following purposes and considerations.
whatsoever be the principal
difference denomination of the offence, between the evil attached
to the offence in its consummate state and
the evil attached to it, in either of its introductory
states a marked difference has place.
1. In the case of the introductory consummate offence,
the evil of both orders, first & second has
place. In the case of the introductory
offence, whether it be actual attempt, or no
more than preparation, the evil of the first
order is wanting.
As to the evil of the second order,
this indeed has place; but, whatsoever
may be the place in regard to the real
danger, the alarm produced by it,
will manifestly be always, in a considerable
degree inferior, to the claim in the
consummated state. Take for instance
an offence of any class, Homicide,
Rape, Theft, Robbery. so many In the
